A Madison County, Illinois woman has filed a lawsuit against her grandmother and uncle after she was attacked by a dog after opening her grandmother’s garage door. According to the lawsuit, the dog had not been on the property during her prior visits to her grandmother’s house.
Christie Helminger filed suit against her grandmother, Maria Tidwell, and her uncle, Edward Tidwell, on March 18, 2014 in Madison County Circuit Court, seeking damages in excess of $50,000.00, after she was attacked by a dog on her grandmother’s property. According to the lawsuit, after opening her grandmother’s garage door, a dog immediately charged her, “biting her on the calves and causing a permanent scar.” Helminger claims the dog, whose breed was not identified in the suit, had not been in the garage on prior occasions when she visited her grandmother.
Helminger’s claims include: “pain, suffering, mental anguish, loss of normal life, disfigurement, injuries both internal and external and expenditures for the cost of healthcare, past and future.” She claims all of these symptoms will continue throughout her life. According to her lawsuit, Helminger’s “grandmother owed her a duty to exercise reasonable care and caution in owning and keeping the dog so as not to cause injury.”
