Pending Dog Bite Case May Affect State Law Regarding Dog Bite Injuries Going Forward.

Lawsuits can be extremely long, complicated, and expensive processes. There are many factors that go into the outcome of a lawsuit, and when people hear the outcome of a given suit, they generally think about the consequences in terms of the practical effects on the parties. However, court decisions can also have implications for the viability of future lawsuits, so judges must take care to understand how far-reaching the implications of a certain decision, or the use of certain language, can be. This applies to topics ranging from contract disputes to cases in which negligence caused a personal injury. In such a situation, it would be wise to contact an expert personal injury attorney at 617-787-3700.

When Joshua Eason came home to stay with his parents and brought along his pit bull, there were signs that it was not the safest situation. The dog apparently snapped at members of the Eason family multiple times, and this potential for injury came to a head when neighbor Lori Steagald came over to see the dog and had her hand viciously bitten. Lori reportedly turned to run, but she tripped and the dog bit her calf, causing further injuries.

Under Georgia law, a dog bite-victim can prevail if he or she is able to show that the dog has previously bitten someone, as that would indicate that the owners were negligent in allowing the dog to be in a position to cause further harm. The Supreme Court of Georgia, however, decided that whether or not the owner should have reasonably known that their dog was dangerous should be a question of fact for the jury, even for a first time bite. This sets a precedent in Georgia dog bite cases and may affect the quality and quantity of cases brought in the future. Eason is being represented by Attorney Andrew Gebhardt.

12 Year-Old North Carolina Resident Slowly Recovering After Suffering Nearly 50 Dog Bites.

Dogs are territorial creatures, and owners are responsible for taking precautions to protect the safety of the visitors whom the dog might see as a threat. Regardless of the precautions taken, which may include chaining the dog to a fence post, the owners of a potentially dangerous dog must make sure that neighbors and passers-by are not in danger of being bitten. Unfortunately, owners can be negligent in this duty, which can lead to serious injuries. In such a situation, it would be wise to contact an expert dog bite attorney at 617-787-3700.

In a particularly gruesome example of an owner’s failure to properly quarantine their dog, a 12 year-old girl residing in Sanford, North Carolina was bitten nearly 50 times by her neighbors’ dog, according to reports. The dog attack occurred after the 7th grader got off the bus returning from school. The girl’s mother, Lateta Verbal, claims that the dog in question is normally chained up, but that the neighbors failed to take that precaution in this instance.

As a result, the child was viciously attacked. Verbal came out of the house to see a crowd of people assisting her daughter, who was badly injured in the dog attack. She was taken to the hospital, but recently released, and is now recovering in her home. The dog has since been taken into quarantine pending the outcome of an investigation that could lead to criminal charges for the owners.
