Seventy-year-old Cheryl Kirkelie was bit on her face by a dog. Her injuries left her with permanent disfigurement. The dog, a mixed-breed, was owned by one David Pimentel. The dog bit her on her upper lip while she was in a mobile home park she co-owns with an LLC.  Pimentel brought his dog to the park while he performed locksmith services. The dog had a history of seizures, which placed the dog at a higher risk of erratic and dangerous behavior.

The dog bite tore through the flesh between Mrs. Kirkelie’s nose and upper lip. She claims she has suffered extreme pain and suffering, and that the injury has left her with permanent, physical injuries that have altered her appearance. She is unable to smile in the way that she could before.

Mrs. Kirkelie filed her lawsuit in the Lane County, Oregon Circuit Court against Pimentel. She is seeking over $35,000, including $5,275 for her medical expenses and $30,000 for her pain and suffering, emotional distress, and disfigurement. The lawsuit alleges that Pimentel failed to control his dog and failed to warn Mrs. Kirkelie that the dog presented a danger.
